Upon approval of the legal office of Guangdong People’s Government, and announcement of Department of Justice of Guangdong after registration by law, Dongguan Sub-commission of Guangzhou Arbitration Commission was established on November 19, 2005. For 15 years, under the care and support of the municipal party committee and government of Dongguan, Dongguan Sub-commission has always adhered to the principle of increasing public credibility of arbitration, serving Dongguan’s economic construction and social development, promoted arbitrations, given full play to the advantages of arbitration to solve commercial disputes, striving for making positive contributions to Dongguan’s market and economic order as well as social harmony and stability.

In recent years, as the downward pressure of the economic resulting in the increase of non-performing assets, many sectors are facing problems such as increasing adverse financial impacts, high level receivables, and acceleration of clear and collection process, especially in the Banking industry. Dongguan Sub-commission took full advantages of the features of arbitration, namely final in the first instance, fast and efficient, and established a financial group to assign special professionals to deal with special cases focusing on financial issues, to guarantee fast trial and settlement of financial disputes, each of which only takes 40 days on average. In 2019, Dongguan Sub-commission accepted 2,220 financial cases, with disputed amounts accumulated to 3.2 billion Yuan. As of April 1 this year, the financial cases have amounted to 1,510 valuing up to 500 million Yuan. ICBC, BOC, CCB, ABC, Bank of Dongguan, RCB, CMB, CIB, Ping An Bank, China Guangfa Bank, Shanghai Pudong Development Bank, and such other financial institutes choose Dongguan Sub-commission as their dispute resolution institute successively.

Guaranteeing equity and justice to be reflected in each case

Dongguan Sub-commission strictly observed the provisions of the Arbitration Law to choose elites from legal and such other sectors with sound social reputation and strong expertise as arbitrators. It attracted many senior lawyers from Dongguan locality, professors from universities, prestigious retired judges, and such other reputable experts and scholars from economic and such other sectors, as well as authorities from each sector to serve as arbitrators, which has reached 302 in Dongguan, meanwhile it trained these arbitrators constantly to improve their expertise of arbitration. Among all cases accepted, those the parties thereto reaching mediation results and withdrawing the application account for 20%, achieving a favorable social effect.

Establishing a communication platform for the community of law profession

In recent years, Dongguan Sub-commission hosted many law salons together with Dongguan Bar, Dongguan Intellectual Property Association, Dongguan Judge Association, and so forth, themed “Hot issues concerning disputes over second-hand house purchase and sell”, “Legal practice on disposal of non-performing assets”, “Overviews of practices on urban updated policy control and risk disputes-taking Shenzhen as example”, “Urban updated fund products design and risk prevention”, “Understanding and application of minutes of trial work of civil and commercial cases of courts across the country”, and so forth. The themes of the salons were close to the legal hot spots with practical and knowledgeable contents and they specially focus on interaction and communications, and the guests invited to share are legal giants of the city, Guangzhou, Shenzhen, even Beijing. Each salon attracts many judges, lawyers, arbitrators, scholars, enterprise managers, and even quite a lot of legal colleagues from Guangzhou and Shenzhen. Basically, each salon was crowded with people and evening the tickets for the standing room were hot catch. Hosting high-quality legal salons has quite positive effects on establishing the communication platform for the community of legal profession in Dongguan, promoting the construction of a nice legal profession ecosystem, and booming the culture of rule of law in Dongguan.

Contribution for construction of rule of law in Dongguan

Dongguan Sub-commission held on to the concept of integrating into the local, serving the locals, striving to offer advice and suggestions, and making communications for the center tasks of Dongguan party committee and government. To cooperate with the strategic objectives of “leading ahead in the implementation of the strategy of innovation-driven development”, Dongguan Sub-commission established an intellectual property arbitration court, to actively cooperate with Dongguan IP Seminar, Dongguan Copyright Association, Patent Association with a focus on offering IP legal protection over the science and innovations of Dongguan, strengthening the building of IP Capacity, and escorting the strategy of innovation driven development. In recent years, as the non-performing rate of banks increase, financial cases raises accordingly, Dongguan Sub-commission timely summarized the conditions of financial disputes, analyzed the reason for their generation, proposed countermeasures, and submitted a special report themed Output of Dongguan Sub-commission of GZAC for Resolving Financial Disputes across the city with the National People’s Congress of Dongguan, policies and law committee under the municipal party committee, municipal financial bureau, municipal justice bureau, and municipal legislative bureau, making a contribution to the stability of Dongguan’s financial market. Dongguan Sub-commission pays attention to strengthen the communication and service coordination with the two level people’s courts of Dongguan, actively accepts distributions of cases to mitigate the pressure of the people’s courts. It also gives full play to the advantages of arbitration, mediation, settlement, and so forth to facilitate the formation and perfection of diversified dispute resolution mechanism of Dongguan and contribute to the economic development and social harmony of Dongguan.
